Samantha: Ed good morning and welcome let's get to it. There are so many questions from casuals, Angela says she wants to know if an employer can ask a casual to work double their normal hours, to in effect earn the job keeper payment and in a different role.
Ed: Hi Samantha, they can ask they can't force people to do extra hours. We're hearing a couple of stories about people being forced to do extra hours, but they can ask and the employee can choose to agree.
What if casuals refuse to do their usual shifts or cut back their hours?
So if a casual refuses to do their shift, it sounds a little to me like they're not regular and systematic which is the language that's being used as to whether people are eligible or not, so you probably wouldn't nominate them going forward if they're refusing in that way.
Ed, Bridgette is wondering whether the employer will make up the rest of the normal wages if a worker earns more than job keeper?
So a couple of parts to this, if in Bridget's case if she's earning more than $1,500 in her usual hours then the employer would have to pay her her normal wages, or as she's on annual leave for example. But if she's on leave without pay or has been stood down, then it's up to the employer if they want to pay her over and up to $1500.
Ed as an extension of that, if you usually get less than $1500 as a casual, does the employer have to pass on the whole $1500 to you or can they keep a bit and just pay you what you normally get?
The first part David you're right that they have to pass on the whole $1500 so they would 'top you up' it's being called, they have to make sure they pass on the $1,500 regardless of how much you earn a fortnight.
So you get a bit of a bonus.
Yes okay, now Simon has a question about tax and super, how are they treated in relation to JobKeeper?
So it seems that there needs to be a bit of clarification on the tax, but it's paid gross so it looks like you do withholding tax through the usual payroll. On super, for wages earned it's just paid in the normal way. Any of these top-up payments that we just referred to the employer chooses as to whether they're going to pay super on top of that.
